Although kratom is legal in New Mexico, the state has implemented regulations to ensure its safety and quality. In 2019, the state passed the Kratom Consumer Protection Act, which requires all kratom products sold in the state to be labeled with their contents and origin. The law also bans the sale of adulterated or contaminated kratom products and prohibits the sale of kratom to minors.
Kratom Legality Status in New Mexico as of 2023
Kratom is fully legalized for consumption and purchase for individuals 18 or older in New Mexico as of 2023. Kratom is currently regulated under KCPA law. Please see below for rules that Kratom vendors must abide by according to the KCPA law.
- Vendors cannot sell adulterated Kratom products that contain non-Kratom substances, that either present an immediate danger or affect the potency of the Kratom product
- Vendors cannot sell Kratom products that have either dangerous, poisonous or scheduled substances present
- Vendors must not sell Kratom products that include Kratom alkaloids or other Kratom compounds
- Vendors cannot sell products that have 7-hydroxymitragynine content above 2% of the Kratom’s total alkaloid content
- Vendors must have labels that show the content of mitragynine and 7-hyfroxymitragyne in the Kratom products
- Vendors must only sell Kratom to those 18 years of age or older
